AETHER LABS LLC – LEGAL DISCLAIMERS & LIMITATION OF LIABILITY

Please read this document carefully. By purchasing products through this website, opening the product packaging, utilizing the adhesive components, or installing the Blade Guard protection system onto a bicycle, you agree to be bound by the following terms, conditions, and liability disclaimers established by Aether Labs LLC, doing business as Aether Labs MTB.

A. PERFORMANCE LIMITS & DESIGN PHILOSOPHY The Blade Guard (including the Gladius, Saber, and Claymore models) is engineered exclusively as a high-performance, sacrificial barrier designed to mitigate minor cosmetic and structural degradation from scratches, routine rock strikes, debris impact, and cable rub. It is not an indestructible shield. Mountain biking is an inherently dangerous sport involving unpredictable forces. Aether Labs LLC does not warrant, represent, or guarantee that the Blade Guard system will protect a bicycle frame against every type of impact, crash, force, or stress.

B. ADHESIVE INTEGRITY & INSTALLATION ERRORS Because the Blade Guard is a Do-It-Yourself (DIY) modular system, the ultimate quality, durability, and longevity of the adhesive bond depend entirely on the user's strict adherence to the official installation guide. Proper surface preparation (including thorough degreasing and contamination removal) and the application of correct pressure are critical. Aether Labs LLC is not responsible for, and expressly disclaims liability for, the failure, loss, or replacement of components that fail to bond due to improper frame preparation, environmental factors during assembly, or user installation errors.

C. FRAME DAMAGE & REMOVAL DISCLAIMER Aether Labs LLC is not liable for any damage caused to the bicycle frame, components, or finishes—including but not limited to paint peeling, clear coat chipping, carbon fiber delamination, discoloration, or structural alteration—resulting from the application, adhesion, presence, or subsequent removal of the Blade Guard protector or its adhesive elements. The user assumes all risks associated with chemical cleaning or physical pulling required during the removal process.

D. THIRD-PARTY MANUFACTURER WARRANTIES The addition of aftermarket accessories or modifications can impact original equipment manufacturer (OEM) structural evaluations. Aether Labs LLC assumes no responsibility or liability in the event that the installation or use of the Blade Guard system voids, alters, or negatively impacts your bicycle manufacturer's factory warranty or insurance policies.

E. LIMITATION OF LIABILITY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AETHER LABS LLC AND ITS OWNERS, DIRECTORS, EMPLOYEES, OR AGENTS SHALL NOT BE HELD LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM THE USE, MISUSE, INABILITY TO USE, OR INSTALLATION OF THIS PRODUCT. BY PURCHASING AND INSTALLING THIS SYSTEM, YOU EXPRESSLY ASSUME ALL INHERENT RISKS ASSOCIATED WITH BICYCLE MODIFICATION, MECHANICAL MAINTENANCE, AND THE RECREATIONAL OPERATION OF BICYCLES. THIS LIMITATION APPLIES REGARDLESS OF WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF AETHER LABS LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.

F. INDEMNIFICATION You agree to indemnify, defend, and hold harmless Aether Labs LLC, its owners, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the website and products; (ii) your violation of any term of these conditions; (iii) your improper installation or misuse of the Blade Guard system; or (iv) any injury or damage caused to a third party resulting from your use of our products.

G. AFFILIATE & THIRD-PARTY REPRESENTATIONS Aether Labs LLC products may be promoted by independent third-party content creators, influencers, or affiliate partners. We are not responsible or liable for any claims, promises, warranties, or misrepresentations made by these third parties regarding the performance, durability, or application of the Blade Guard system. All official product capabilities and warranties are limited strictly to those expressly stated on aetherlabsmtb.com.

H. GOVERNING LAW & JURISDICTION These terms, disclaimers, and agreements shall be governed by, construed, and enforced in accordance with the laws of the State of Maryland, United States, without regard to its conflict of law principles. Any legal action, suit, or proceeding arising out of or relating to this product or website shall be instituted exclusively in the state or federal courts located in the State of Maryland.

I. SEVERABILITY & ENTIRE AGREEMENT If any provision of these terms is determined by a court of competent jurisdiction to be unlawful, void, or for any reason unenforceable, then that specific provision shall be deemed severable from these terms and shall not affect the validity, legality, and enforceability of any remaining provisions. This document, alongside our standalone Shipping and Returns policies, constitutes the entire agreement between the user and Aether Labs LLC regarding the liability and service terms of the Blade Guard product line.
